| Resumo: | O presente artigo tratará do histórico nacional e internacional da criação do instituto da audiência de custódia, buscando estabelecer parâmetros mínimos para que mantenha sua efetividade no combate à tortura e aos maus tratos, na garantia dos direitos do preso, na discussão da legalidade e necessidade da prisão. Entende-se que esse é um mecanismo de controle judicial e de humanização do processo penal brasileiro alinhado aos parâmetros internacionais, valendo-se tanto da legislação interna acerca do tema, quanto da jurisprudência de cortes internacionais. Também é objetivo desse texto explicitar os objetivos e princípios aos quais as audiências de custódia se submetem, além de discutir a questão de sua realização por videoconferência e as mudanças advindas da Lei 13.964/2019. |
| Abstract: | This article will deal with the national and international history of the creation of the custody hearing institute, seeking to establish minimum parameters to maintain its effectiveness in combating torture and ill-treatment, in guaranteeing the rights of prisoners, in discussing the legality and necessity of prison being a mechanism for judicial control and for the humanization of the Brazilian criminal process, adapting to international parameters, making use of both the internal legislation on the subject and the jurisprudence of international courts. It will also seek to explain the objectives and principles to which custody hearings are submitted, in addition to discussing the question of their realization by videoconference and the changes arising from Law No. 13.964 / 2019. |
