| Resumo: | A Lei 13.964/19, em vigor desde o dia 23 de janeiro de 2020, foi sancionada com a intenção de aperfeiçoar a legislação penal e processual penal do país. Dessa forma, passou-se a permitir a execução provisória da pena no âmbito do Tribunal do Júri quando a pena for igual ou superior a 15 (quinze) anos de reclusão. Então, o presente artigo tem como objetivo analisar se esta modificação na lei gera violação ao princípio da presunção de inocência e, consequentemente, se é inconstitucional. |
| Abstract: | The Law 13.964/19, in force since January 23, 2020, was sanctioned with the intention of improving the country’s criminal and procedural law. Thus, started to allow the provisional execution of the sentence within the scope of the Jury Court when the penalty is equal to or greater than 15 (fifteen) years of reclusion. So, this article aims to analyse whether this change in the law violates the principle of the presumption of innocence and, consequently, if it is unconstitutional. |
