| Resumo: | A relação entre Direito e tecnologia tem movimentado o debate jurídico nos últimos tempos, considerando os direitos fundamentais que surgem dessa intersecção. Este artigo busca demonstrar, sob esses contornos jurídicos e digitais, que os efeitos da pandemia do coronavírus foram mais injustos às pessoas com deficiência. Adota-se como referencial teórico a teoria da justiça social como paridade participativa, elaborada por Nancy Fraser, quem abarca ao seu discurso, a redistribuição e o reconhecimento. Ademais, utiliza-se do raciocínio hipotético-dedutivo, aliado às pesquisas bibliográficas e documentais. Verificou-se, ao final, que o surto sanitário provocado pela COVID-19 digitalizou as relações sociais, reforçando uma genuína exclusão, tendo em vista o desrespeito existente a um importante direito fundamental, qual seja, a acessibilidade digital. |
| Abstract: | The relationship between Law and technology has moved the legal debate in recent times, considering the fundamental rights that arise from this intersection. This article seeks to demonstrate, under these legal and digital outlines, that the effects of the coronavirus pandemic were more unfair to people with disability. As a theoretical framework is adopted the theory of social justice as participatory parity, elaborated by Nancy Fraser, who covers her discourse with redistribution and recognition. In addition, it uses hypothetical-deductive reasoning, together with bibliographic and documentary research. In the end, it was found that the health outbreak caused by COVID-19 digitalized social relations, reinforcing genuine exclusion, in view of the existing disrespect for an important fundamental right, namely, digital accessibility. |
