| Resumo: | O presente artigo visa a analisar a representação de gênero no judiciário brasileiro a fim de verificar se há falsa representação das mulheres nessa instituição, como hipótese causal do modo como os magistrados(as) decidem a ponto de reiterar violências de gênero. Adota-se como referencial teórico a teoria da justiça pós-westfaliana de Nancy Fraser, segundo a qual não havendo representação não é possível efetivar a dimensão política de justiça e, consequentemente, as de reconhecimento e distribuição. Utilizam-se para tal investigação análises secundárias de pesquisa sobre composição do Poder Judiciário, revisão bibliográfica, análise quantitativa de currículos de cursos de Direito, além do exame de decisão judicial a fim de exemplificar a hipótese levantada. |
| Abstract: | This article aims to analyze the representation of gender in the Brazilian judiciary in order to verify if there is a misrepresentation of women in this institution, as a causal hypothesis of the way in which magistrates decide to the point of reiterating gender-based violence. Nancy Fraser's theory of post-Westfalian justice is adopted as the theoretical reference, according to which if there is no representation it is not possible to implement the political dimension of justice and, consequently, those of recognition and distribution. Secondary analyses of research on the composition of the Judiciary, bibliographic review and quantitative analysis of curricula of law courses are applied for such investigation, in addition to the examination of judicial decision, in order to exemplify the hypothesis raised. |
