| Resumo: | A presente monografia visa realizar uma análise crítica sobre a decisão do Superior Tribunal de Justiça, no julgamento do Recurso Especial nº1.677.079-SP, que determinou a extensão da proteção do bem de família legal, conferida pela Lei 8.009/90, ao direito do devedor fiduciante. Nesse sentido, oferece-se uma alternativa ao entendimento adotado pela Corte Superior, com o intuito de prezar por uma execução mais equilibrada, considerando tanto as particularidades trazidas pela doutrina minoritária acerca da penhora dos direitos do devedor fiduciante, quanto sobre o direito real de aquisição do terceiro arrematante, sem olvidar-se ainda da possibilidade da manutenção do direito de posse do fiduciante. Destaca-se, por fim, a necessidade de se atentar à prática forense no que diz respeito ao contrato de alienação fiduciária em garantia de bem imóvel, bem como ao estudo atento do negócio fiduciário, haja vista que são muitas as controvérsias que envolvem os julgamentos que versam sobre o tema, especialmente, em face da judicialização do processo de execução mediante o interesse de terceiros. |
| Abstract: | This study aims to realize a critical analysis about the judicial ruling of the Superior Court of Justice, in the judgment of Special Appeal No. 1.677.079-SP, which determined the extension of homestead allowance protection, granted by Law nº 8.009/90, to the trustor’s right. In this sense, one offers an alternative to the understanding adopted by the Superior Court, in order to ensure a more balanced legal execution, considering particularities brought by the minority doctrine about the attachment of trustor’s rights, as well as the bidder’s real right of acquisition, without forgetting the trustor’s entitlement to the right of possession. Finally, it is important to point out the necessity of awareness of court practice regarding fiduciary alienation, once there are several controversies about fiduciary transactions’ rulings, specially, concerning to judicialization of execution in the face of third parties’ interests. |
