| Resumo: | O presente trabalho pretende explanar sobre a evolução do modus operandi do crime organizado no Brasil e a consequente necessidade que o Direto Penal encontrou em aprimorar seus instrumentos de persecução penal, o que fez através do implemento da colaboração premiada. Em análise da aplicação desse instituto, discutir-se-á sobre o desrespeito latente aos limites impostos pelo ordenamento jurídico, no entanto, não será considerado apenas o texto da Lei 12.850/2013, recorte legal desse trabalho, mas também a realidade prático-jurídica que cerca o instituto, considerando que a interpretação que o Poder Judiciário e a atuação do Ministério Público são o que o caracterizam e delimitam atualmente. |
| Abstract: | This paper intends to explain the evolution of the modus operandi of organized crime in Brazil and the need that Criminal Law has found in improving its instruments of criminal prosecution, which it did through the implementation of the Plea Bargainig. Analyzing the application of this institute, we will discuss latent disregard for the limits imposed by the legal system, however, not only it will be considered the text of Law 12.850 / 2013, legal clipping of this article, but also the practical legal reality which surrounds the institute, considering that the interpretation that the Judiciary and the performance of the Public Prosecutor's Office are what characterize it and delimit actually. |
