| Resumo: | A presente monografia tem por objetivo analisar o Princípio da Insignificância no Direito Penal Brasileiro, estudando os conceitos, a origem, sua aplicabilidade, requisitos e outros princípios a ele relacionados, esquadrinhando sua aplicação em determinados delitos. Busca, assim, refletir acerca da diferenciação entre o furto de pequeno valor e a aplicação do princípio no crime de descaminho. Além disso, tem por desígnio sopesar as jurisprudências dos Tribunais Superiores, para ao fim concluir sobre a necessidade de um maior apuro na exegese desse importante princípio pelos aplicadores do direito. |
| Abstract: | This dissertation aims to analyze the Pericle Offenses in the Brazilian Criminal Law, studying the concepts, the source, its applicability, and other requirements related to the Pericle Offenses, analyzing your application in certain crimes. Search thus reflect on the differentiation between the theft of small value and the application of the principle in the crime of embezzlement. In addition, consider the case design of the Superior Courts, to the end conclude on the need for greater trouble in the exegesis of that important principle by the executors of law. |
