| Resumo: | O presente estudo busca analisar a aplicação dos Precedentes Judiciais inseridos no ordenamento jurídico brasileiro, tradicionalmente pertencente ao sistema de civil law. Para tanto, através de uma comparação bibliográfica, verificou-se a estrutura do precedente judicial, bem como sua classificação, natureza jurídica e formas de aplicação, no intuito de se compreender o instituto. Em seguida, aprofundou-se na dinâmica dos precedentes, através de suas formas de distinção e superação. Por fim, analisou-se a eficácia dos precedentes judiciais no tempo, propondo a possibilidade de modulação dos efeitos nos casos de reforma e criação da norma-precedente. |
| Abstract: | This study analyze the application of the theory of judicial precedents inside of the Brazilian legal system, which on traditionally belongs to the civil law system. For this, through a bibliography comparation, the structure of the precedent, also its legal nature and application are analyzed, seeking the understanding of the institute. Then, the dynamic of the judicial precedent are examined, like the distinguishing, overriding and overruling. Lastly, the efficiency of the judicial precedent are analyzed, proposing an effect modulation on time of the reform of the precedent norm. |
