Meninas em conflito com a lei: uma análise do cumprimento de medida socioeducativa de internação para adolescentes do sexo feminino

Abstract

The present study aims to reflect on the main characteristics of the implementation of a socioeducative measure of hospitalization for female adolescents, based, above all, on the analysis of the socioeconomic profiles of these adolescents. From a brief historical analysis, it is intended to demonstrate the evolution of Juvenile Justice in Brazil until the promulgation of the Statute of the Child and Adolescent, with the subsequent advent of Law 12.594/12 (Law of the National System of Socio-Educational Assistance), and as its peculiarities and innovations. Next, considerations will be drawn about how the patriarchal culture present in our society, the transformation of the feminine social roles and the reduced contingent of adolescents deprived of freedom influences the scarce number of researches and scholarly works about this reality, diverting the creation solutions. In addition, through these considerations, the study proposes to demonstrate, based on a critical perspective, how the figure of adolescents who commit infractional acts is socially constructed and in which contexts these young people are inserted.
