| Resumo: | O artigo apresenta uma visão crítica acerca do instituto da arbitragem aplicado na esfera trabalhista. O objetivo é analisar se a arbitragem sob os novos moldes da reforma trabalhista é coerente com os entendimentos atuais na doutrina e nos Tribunais e se é capaz de trazer maiores vantagens ou desvantagens ao trabalhador. Antes das indagações propostas, o presente trabalho perpassa pela conceituação e natureza jurídica da arbitragem, o seu modelo nos EUA e o panorama histórico. Ademais, são realizados questionamentos com relação à aplicação indiscriminada do referido procedimento em todos os conflitos trabalhistas e a busca excessiva pela celeridade no Judiciário que não significa necessariamente decisões mais justas. |
| Abstract: | The article presents a critical view about the institute of arbitration applied in the labor matters.The goal is to analyze if the arbitration in the new molds of the labor reform is consistent with the actual understandings in the doctrine and in the Courts and to see if it's capable of causing more advantages or disadvantages to the work class. Before the proposed inquiries, the present work goes through the conceptualization and arbitration's legal nature your model in the USA and your historical perspective. Beyond that, questions are raised regarding the indiscriminate application of this procedure in all labor disputes and the search for speed in the Judiciary, which does not necessarily mean fairer decisions. |
