Abstract

This article aims at analyzing and discussing the internship in its non-compulsory modality, starting with the influence of the neoliberal State and its reflexes in the internship contract, given the great interest of employers in increasing productivity and reducing Of the social and economic burdens arising from the bargaining relationship of employment, which leads to the fraudulent use of the stage, with the consequent precariousness of labor relations. The objective was to highlight the problems that permeate the realization of the non-compulsory internship and the flexibilization of work in light of Law 11.788 / 2008. The method adopted in this research is the analysis of the Law of Internship, national doctrine and comparative law, with a focus on approaching fraud in this contractual relationship. The results evidenced the connection between changes in labor law, due to the flexibilization of labor relations and contracts, and the lack of supervision of internships, which underscores the need for a (re) normative interpretation, so that this Branch of law to accompany the cultural changes and not be obsolete before the social needs.
