| Resumo: | O presente estudo tem utilidade médica, legal e social, vez que cuida do transexualismo que é um distúrbio psicológico, traz repercussões quanto ao registro civil e é um tema pouco explorado e imerso em preconceito. Este trabalho tem o escopo de demonstrar o quão importante é a cirurgia de transgenitalização para adequação do sexo físico ao sexo psicossocial e a retificação do assentamento civil dos transexuais quanto ao prenome e gênero tendo como objeto de análise o entendimento do Superior Tribunal de Justiça que fundamenta a alteração do assentamento civil na dignidade humana que, por sua vez, para o Tribunal, tem lastro na autodeterminação. Ocorre que a autodeterminação é atributo dos indivíduos que se encontram no centro da comunidade moral; em sua periferia, indivíduos há que não gozam desse atributo, de modo que discute-se se seria a autodeterminação o que embasa a dignidade humana, sendo o fundamento do Princípio da Dignidade da Pessoa humana o ponto de mais alta indagação desta monografia. |
| Abstract: | The present study has medical utility, legal and social, since it takes care of transsexualism is a psychological disorder, has repercussions on the civil registry and is a relatively unexplored subject and immersed in prejudice. This work has the scope to demonstrate how important is the reassignment surgery to ensure adequate physical sex to sex and psychosocial rectification civil settlement of transsexuals as the first name and gender with the object of analysis to understand the Superior Court of Justice that supports change in the civil settlement in which human dignity, in turn, to the Court, has ballast in self-determination. Is that self-determination is an attribute of individuals who are at the center of the moral community, at its periphery, there are individuals who do not enjoy this attribute, so that would be open for discussion if the self-determination which underpins human dignity, being the foundation of principle of the Dignity of the human Person highest point of inquiry of this monograph. |
