Abstract

This study aims to analyze the influence of the media on the verdicts of the jury. Based on the notion that the Court is a tribunal with democratic origins and justifications, which provides processing in that it allegedly violated the normative precepts by their peers, emerging in that sense, for an analysis, as much as possible, free and straight the facts sub judice. We demonstrate how the commercial interests of the media corrupts the goals of justice and democracy to which it provides the Court, in light of punitive populism, aiming to identify the extent to which the constitutional principle of presumption of innocence aureus remains, in many cases, deadly injured in his face material, resulting in pre-established judgments and misrepresenting, irrevocably, the results of the analysis by lay judges. Looking tangent at the end, the need for a balancing of values in the criminal process that prioritizes this principle at the expense of freedom of the press unregulated.
