| Resumo: | O principal objetivo deste trabalho é analisar a possibilidade de expulsão do condômino antissocial, como forma de punição mais severa pelo desrespeito reiterado às normas comuns e ante a insuficiência da aplicação das multas previstas no Código Civil para coibir a prática dos mesmos atos. O condômino antissocial que desrespeita as normas de convivência não está observando a sua função social da propriedade, logo não está exercendo-a de maneira plena. Entendendo que a função social age duplamente, ora como fundamento ora como limitação do direito de propriedade, o comportamento nocivo deste condômino não pode ficar impune. Para superação do problema, realizar-se-á uma pesquisa qualitativa, extraindo de textos legais, doutrinários e jurisprudenciais substratos que possam ser analisados, considerando-se os direitos de propriedade e de vizinhança, a vedação ao abuso do direito, bem como os princípios constitucionais que permeiam tais institutos. Por fim, discute-se a possibilidade de o julgador aplicar uma sanção não prevista em lei, qual seja, a exclusão do condômino antissocial. |
| Abstract: | The main purpose of this article is to analyze the possibility of banishing the antisocial resident of condominium, as a more severe punishment for repeatedly disrespect the common rules and due the inefficiency of applying the fines from the Brazilian Civil Code to restrain these unwanted acts. The antisocial resident of condominium that disrespect the rules for living is not regarding the social function of the property, thus is not fully exercising the property right. Once the social function acts doubly, first as a fundament for the property right second as a bound, the antisocial behave can be unpunished. To overcome the problem, will be realized a qualitative research, extracting from legal texts, doctrine and jurisprudence concepts that can be analyzed considering the property right, the neighborhood right, the inhibition of abusing rights and the constitutional principles that surround this rights. Finally, will be discussed the possibility of judges apply a sanction that is not in law, which is the banishment of the antisocial resident of the condominium. |
