dc.description.abstractThis research presents a discussion on current linguistic rights in modern society, from the viewpoint of Legal Sciences. By considering the deaf people as a cultural and linguistic minority, we have analysed the international legal instruments and the Brazilian legal system with respect to the set of rights related to the deaf community. By using the deductive approach, which was conducted by means of literature review, we have analysed how the Theory of Fundamental Rights can help (re)evaluate the topic of linguistic rights, so as to affect and encourage an egalitarian, active, and complete participation of Brazilian deaf people in our society. Based on the concepts and suppositions derived from the Theory of Fundamental Rights, we have concluded that the Brazilian legal system, both its Constitution (BRASIL, 1988) and infra-constitutional rules, offer elements for the establishment of public and linguistic policies that can guarantee for the Brazilian Deaf the right to use their own language within their communities and outside them, in formal and informal settings. This allows them not only to be regarded as individuals, but also as citizens, capable of enjoying all their rights with dignity, freedom and on equal footing with the other members of society who are speakers of languages that are more widely acknowledged, more prominent and have a higher status.pt_BR
dc.description.resumoNesta pesquisa, apresenta-se, a partir da perspectiva das Ciências Jurídicas, uma reflexão sobre os direitos linguísticos na atualidade. Com base na concepção dos surdos como uma minoria linguística e cultural, verificaram-se os instrumentos legais internacionais e o ordenamento jurídico brasileiro em relação ao conjunto de direitos voltados à comunidade surda. Por meio de uma perspectiva dedutiva conduzida através de uma pesquisa bibliográfica-documental, analisou-se como a Teoria dos Direitos Fundamentais pode ajudar a (re)pensar a questão dos direitos linguísticos, para que estes sejam capazes de impactar e orientar a participação igualitária, ativa e plena dos surdos brasileiros na sociedade atual. Conclui-se, com base nos conceitos e nos pressupostos decorrentes da Teoria dos Direitos Fundamentais, que o ordenamento jurídico brasileiro, tanto a Constituição (BRASIL, 1988) quanto as leis infraconstitucionais, oferecem elementos para a definição de políticas públicas e de políticas linguísticas capazes de garantir aos surdos brasileiros seu direito de uso da própria língua em suas comunidades e, além delas, em contextos formais e informais. Isso possibilita que se constituam não somente como sujeitos, mas como cidadãos capazes de gozar de seus direitos com dignidade, liberdade e em igualdade com os demais participantes da sociedade, que são falantes de línguas com maior reconhecimento, destaque e status social.pt_BR
