Direito penal e feminismo: a criminalização da "revenge porn" à luz da influência dos movimentos sociais e do direito comparado

Abstract

This work has the goal to approach the growth of the cybercrimes and, among them, disentangle the growing phenomenon of “revenge porn”, establishing a concept and comprehending it in order to identify which would be the best legal treatment for the object. The work analyses the evolution of the national criminal law, under the influence of social movements – specially, feminism, and comparative law, as well as the legal treatment which is given to the theme on national soil, furthermore, around the globe. Thereby, working on the basis that is harder to suppress the cybercrimes and the particularities of the explored subject and its intrinsic relation with the struggle for gender equality demands a more specific approach in the domain of Law, supporting itself on the constitutional principle of privacy protection, it is purposed the need to elaborate a specific penal norm for a fair and correct revenge porn legal treatment.
