O princípio da centralidade do sofrimento da vítima e seus reflexos na prestação jurisdicional brasileira: uma análise do crime de Mariana

Abstract

The purpose of this course conclusion work is to analyze the construction of the Principle of Centrality of the Victim’s suffering from its genesis in the framework of the Inter-American Court of Human Rights, where it began to be coined and applied by Judge Antônio Augusto Cançado Trindade, considering Also its legalphilosophical context. To that end, I will present the structure of the Inter-American System for Protection of Human Rights and analyze some of the judgments of its Court. The ultimate goal of this work, however, is to demonstrate the importance of applying this principle in cases of judicialization of human rights violations. Therefore, I will make a case study of the breakdown of the dam in Mariana in order to highlight the advantages of applying this principle. I will treat this case as an example of the proper application of the Principle of Centrality of Victim’s Suffering as this is a case with such alarming proportions in terms of damage to the environment and violations of other Fundamental Human Rights, such as human life, which is being considered The largest social-environmental crime in Brazil.
