| Resumo: | Trata-se de artigo científico que propõe uma análise do recente (2010 a 2018) desenvolvimento da prática arbitral no Brasil sob a ótica do desenvolvimento histórico/genealógico da Verdade na tradição ocidental. Constrói-se uma analogia inversa com a construção histórica proposta por Michel Foucault sobre o ocorrido nos séculos XII e XIII na Europa, quando o poder Soberano passa a exercer controle sobre as contestações judiciárias pela forma do inquérito administrativo-religioso. |
| Abstract: | This scientific article proposes an analysis of the recent (2010 to 2018) development of the arbitration practice in Brazil from the perspective of the historical/genealogical development of the Truth in the Western tradition. We construct an inverse analogy with the historical construction proposed by Michel Foucault on what happened in centuries XIII and XIII in Europe, when the Sovereign begins to exercise control over the judicial challenges by the form of the administrative-religious inquiry. |
