Direito do Trabalho e a liberdade econômica: a lei n.º 13.874/2019 e seus impactos na proteção do meio ambiente laboral

Abstract

The purpose of this study is to make a critical analysis of law 13.874 / 2019, originated from the Economic Freedom MP, in the light of Labor Law. Therefore, we will start from the theoretical framework of the economist Amartya Sen, to argue that the concept of freedom and development requires the preservation of the dignity of the worker. Then, through bibliographic review and document analysis, we will develop the present work. In addition, to point out the unconstitutionalities in the legislative process of that law, we will deal with changes related to the field of the work environment, to then indicate that the legislation is going to worsen the national picture of accidents at work. Through this analysis, it will remain clear that the new law, instead of ensuring a real improvement in economic conditions, only uses the same neoliberal speech to worsen deregulation in the labor area. In this context, the hurried and antidemocratic discussions that fostered the referred legislation end up maintaining precarious situations for workers, which is why it must be combated and removed.
