A ideia de direito no pensamento de Adolf Reinach e Edith Stein

Abstract

In the present dissertation is presented the thought of Adolf Reinach and Edith Stein on the idea of Law. Reinach and Stein investigate the possibility of grounding the Law through a phenomenological attitude, inspired by Husserl’s Logical Investigations. The idea of Law is exposed in the second and third chapter having as principal references Reinach’s The A priori Foundations of Civil Law and Stein’s Philosophical Writings on the State. Both share the idea of a priori fundamentals to the Law, however departing from different living events. In the fourth chapter, the similarities on the grounding of Law presented by Reinach and Stein are investigated. In the fifth chapter, the differences between the thought of both phenomenologist are examined. In the conclusion, I defend that phenomenological method offers an innovative and consistent grounding to the Law.
