Resumo: Este artigo investiga o impasse jurídico-administrativo envolvendo a Polícia Rodoviária Federal (PRF) na apreensão de veículos que tenham exclusivamente restrição judicial de circulação de natureza cível e trabalhista no Renajud. A análise faz um resgate histórico, a partir de 2008, das dificuldades operacionais enfrentadas pelo órgão até a sua abstenção definitiva em 2014, decisão respaldada no acolhimento de pareceres da Advocacia-Geral da União (AGU) que assentam que a execução de ordens dessa natureza incumbe aos oficiais de justiça. Assim, o trabalho investiga as limitações operacionais e se a PRF teria a competência para dar cumprimento às decisões de natureza não criminal. Em resposta, sustenta-se que a colaboração institucional não deve ser afastada de plano, mas sim estruturada sob o prisma da cooperação. Sendo a PRF um órgão do Estado, subsiste o seu dever legal de cumprir e fazer cumprir as ordens judiciais no âmbito das rodovias federais e nas áreas de interesse da União. Ademais, eventuais limitações operacionais podem ser superadas mediante a celebração de Acordos de Cooperação Técnica (ACT) entre os Tribunais, Superintendências da PRF e Detrans. Essa articulação viabiliza o cumprimento e harmoniza a efetividade da tutela jurisdicional com a capacidade administrativa do órgão, sem comprometer suas funções constitucionais de segurança pública e fiscalização de trânsito. Para tanto, a pesquisa se apoia em uma abordagem qualitativa, exploratória, bibliográfica e interdisciplinar, com análise de documentos oficiais, utilizando a técnica de ponderação de princípios como procedimento lógico para solucionar conflitos entre interesses opostos.
Abstract: This article investigates the legal-administrative impasse involving the Federal Highway Police (PRF) regarding the seizure of vehicles subject solely to civil or labor-related judicial driving restrictions recorded in the Renajud system. The analysis traces the history of operational difficulties faced by the agency from 2008 until it definitively ceased this practice in 2014—a decision based on legal opinions from the Office of the Attorney General of the Union (AGU) establishing that the execution of such orders falls to court bailiffs. Thus, the study examines operational limitations and whether the PRF possesses the authority to enforce non-criminal judicial decisions. It argues that institutional collaboration should not be summarily dismissed but rather structured through a framework of cooperation. As a State agency, the PRF retains a legal duty to comply with and enforce court orders within federal highways and areas of federal interest. Furthermore, potential operational constraints can be overcome through Technical Cooperation Agreements (ACTs) between the courts, PRF regional superintendencies, and state traffic departments (Detrans). Such coordination enables enforcement and harmonizes the effectiveness of judicial relief with the agency's administrative capacity, without compromising its constitutional functions regarding public security and traffic enforcement. To this end, the research employs a qualitative, exploratory, bibliographic, and interdisciplinary approach involving the analysis of official documents, utilizing the technique of balancing principles as a logical procedure to resolve conflicts between opposing interests.
