Discutindo desenvolvimento e Direitos Humanos: a atuação do BNDES sob a perspectiva Poulantziana de Estado e seu reflexo nas violações aos Direitos Humanos por empresas

Abstract

This paper aims to discuss how the tension between development and Human Rights marks the proceeding of an economic apparatus of the Brazilian State (BNDES). With this purpose, it seeks to establish a counterpoint between the traditional theory of the State and the perspective offered by the Nicos Poulantzas’ theory, combined with the critical conception of Human Rights, according to which humanity has always despised some of its parts, denying them the enjoyment of such Rights. It analyzes the historical process of foundation and consolidation of the bank and its role in the transformations experienced by Brazilian capitalism, as well as the main forms of proceeding of the institution in the present time. It discusses the bank's institutional policy, its governance mechanisms and the phenomenon of capture, which can occur from the approach with corporate power. At the end, a case study is presented, involving the conflict caused by an enterprise directly linked to the BNDES and traditional peoples and communities.
