| Resumo: | Este trabalho analisa a possibilidade de responsabilização dos envolvidos no conflito Israel-Hamas por crimes de lesa-humanidade perante o Tribunal Penal Internacional (TPI). A pesquisa aborda o histórico, os princípios e os crimes de competência do TPI, seguida de um resumo do contexto geopolítico do conflito, com foco nos eventos de 7 de outubro de 2023. Analisa-se a decisão fundamental da Câmara de Pré-Julgamento do TPI que reconheceu a jurisdição da corte sobre o território palestino com base na adesão da Palestina ao Estatuto de Roma, o que viabilizou a emissão de mandados de prisão para lideranças de Israel e do Hamas. Por fim, são examinadas, em tese, condutas de ambos os lados que poderiam ser enquadradas como crimes de guerra e crimes contra a humanidade, conforme as investigações do Procurador do TPI. |
| Abstract: | This paper analyzes the potential accountability of those involved in the Israel-Hamas conflict for crimes against humanity before the International Criminal Court (ICC). The research covers the ICC's history, principles, and the crimes falling under its jurisdiction, followed by a summary of the geopolitical context of the conflict, with a focus on the events of October 7, 2023. It examines the fundamental decision by the ICC's Pre-Trial Chamber that recognized the court's jurisdiction over Palestinian territory based on Palestine's adherence to the Rome Statute, which enabled the issuance of arrest warrants for leaders from both Israel and Hamas. Finally, the paper theoretically scrutinizes actions by both sides that could be classified as war crimes and crimes against humanity, according to investigations by the ICC Prosecutor. |
