O conjunto probatório e o vídeo como prova dos contratos de empréstimo consignado celebrados eletronicamente em agências físicas: uma análise exploratória a partir dos acórdãos proferidos no Tribunal de Justiça do Estado de Minas Gerais

Abstract

This dissertation aims to examine the body of evidence and the video as evidence of payroll loan contracts entered into electronically at physical branches. Its purpose, based on the analysis of the judgments handed down by the Court of Justice of the State of Minas Gerais, was to: verify how the judges' reasoning on the matter is being carried out; identify the evidence commonly presented by financial institutions to prove the contracts discussed; observe whether the understanding given by the Court is pacified or whether there is divergence on the subject; and examine the judges' stance in cases where there is a request by the plaintiff for the bank to be compelled to present the footage from the establishment's internal security circuit relating to the day on which the legal transaction was agreed upon. The approach adopted in this final course work will be qualitative, in which, based on the decisions of the State Court of Minas Gerais, it will be possible to verify the criteria used by the judges in conducting the trial. In order to prepare this dissertation, bibliographical materials, consultations of current legislation and case law decisions were used.
