O papel do MPT na construção de uma regulação das plataformas digitais sob demanda: o trabalho para empresas de entrega

Abstract

This paper will demonstrate, in summary, the importance that the Public Ministry of Labor has in the fight for a regulation of employment in digital platform applications. With the advent of the COVID-19 pandemic, social inequalities became more visible and, in the sphere of on-demand work, even more so. Technological advancement drives the development of new ways of working, including those developed by application delivery companies. To address the topic, case studies will be used, applying the critical deductive method and with a dialogue between sociology and law, through bibliographic and jurisprudential research. The objective was to inquire about the existence of an employment relationship in the work relationships signed between the motofretista and the iFood company, as well as to identify, if so, the subject responsible for the payment of labor rights. It was concluded that, all the requirements of the employment relationship between the worker and the iFood company are present.
