| Resumo: | O presente trabalho monográfico examina a aplicabilidade das decisões estruturantes no direito brasileiro. Para tanto, será abordada a origem do instituto das structural injunctions , as características dos litígios estruturais, o modelo de processo mais adequado para o desenvolvimento de referid os litígios e as críticas à postura do magistrado ativista, que prolata decisões estruturais. Por fim, serão tecidas considerações acerca da necessidade de se conferir efetividade aos pronunciamentos judiciais, bem como acerca dos parâmetros para a impleme ntação das decisões estruturantes no Brasil. |
| Abstract: | The present m onographic work examines the applicabil ity of structuring decisions in Brazilian law. Therefore, i t will be approached the origin of the structural injunctions institute, the structural litigation’s characteristics, the most appropriate procedure f or the development of such litigation, t he criticism of the activist magistrate's stance, which renders structural decisions. Finally, considerations will be made about the importance to give more effectiveness to the judicial pronouncements and about the parameters for the implementation of struct ural decisions in the Brazilian system of law. |
