| Resumo: | O presente artigo propõe um estudo do tipo penal do estelionato previdenciário, previsto no artigo 171, §3º, do Código Penal, de sua natureza e classificação. Pretende-se analisar o sujeito ativo deste delito, sua realidade social, modus operandi, e a sua relação com a punibilidade, de acordo com o ordenamento jurídico brasileiro. Quanto à metodologia, além da indispensável revisão bibliográfica, vale mencionar que os dados que subjazem o estudo foram obtidos a partir do estágio acadêmico realizado no gabinete da 4ª Vara Federal da Subseção de Juiz de Fora, Minas Gerais. A experiência possibilitou o acompanhamento de audiências realizadas nos processos envolvendo este delito, no trâmite processual, e das decisões e sentenças proferidas. É o que se pretende compartilhar, a fim de contribuir para o debate criminológico-crítico sobre o tema. |
| Abstract: | The present paper proposes a study of the crime of social security stelionate, provided for in Article 171, §3, of the Criminal Code, of its nature and classification. It is intended to analyze the active subject of this crime, its social reality, modus operandi, and its relation with punishability, according to the Brazilian legal system. Regarding the methodology, besides the indispensable bibliographical revision, the studies of crime were obtained from the academic stage in the office of the 4th Federal Court of the Subsection of Juiz de Fora, Minas Gerais. The experience enabled the follow-up of hearings conducted in the processes involving this crime, in the procedural process, and of the decisions and sentences. This is what we intend to share in order to contribute to the criminological-critical debate on the subject. |
