| Resumo: | A temática abordada no presente trabalho insere-se no campo da Filosofia do Direito e da Bioética, e tem como foco a discussão em defesa da possibilidade de se atribuir ao animais não-humanos a condição de sujeitos de direitos no ordenamento jurídico brasileiro. Assim, através de uma análise da legislação brasileira atual, principalmente no que tange a doutrina e legislação civil pátria, enfatiza-se a necessidade de mudanças em relação ao enquadramento dos não- humanos no Código Civil, passando de meros objetos para a de sujeitos de direitos dentro das relações jurídicas, visto a já comprovada semelhança entre os mesmos os seres humanos, principalmente no que tange senciência e sua capacidade de sofrimento, atributos estes não exclusivos da raça humana. O problema central subsiste na existência de práticas antropocêntricas enraizadas no pensamento ocidental, contrapondo-se ao pensamento biocêntrico. Para tanto, estabeleceu, como objetivo geral, proporcionar melhor compreensão acerca do tema, para que só então seja possível realizar uma análise sobre a condição jurídica dos animais, com o escopo de detectar a controvérsia existente no direito brasileiro. |
| Abstract: | This study is about law philosophy and bioethics, and it focuses on the discussion towards the possibility of atributing to non-human animals the condition of sunjects of law within the current planning of the brazilian legal system. Thus, through a thorough analisys of the current brazilian legislations, in particular civil law, changes regarding the inclusion of non-humans in the civil code are needed urgently, going fron mere objects to having liability within legal relations, given the proven similarities among the same human beings, particularly on sentience and their capability of sufferinf, which are traits that are not exclusive to humans. The main probleim lies within the existence of anthropocentric policies, which are rooted in western thoughts going against byoethics concepts. As such, it was established, as the main objective of this study to provide a better understanding of the matter and then, to make a full analysis on the lawful condition of animals, with the invention of detecting the controversy that exists within the brazilian law. |
