Title: O testamento vital no Brasil e as dificuldades para sua legitimação

Resumo: O objetivo do presente artigo é analisar o instituto do testamento vital no ordenamento jurídico brasileiro. Devido aos patentes avanços da Medicina nas últimas décadas, tornaram-se mais comuns as situações limítrofes entre vida e morte, em que o indivíduo, enquanto paciente, encontra-se incapaz de expressar sua vontade quanto aos cuidados e tratamentos médicos que deseja receber. Apesar de pouco conhecido em nossa sociedade, o testamento vital tem se revelado cada vez mais um instrumento útil e necessário à efetivação da autonomia privada nas referidas situações. O exercício da autonomia, por sua vez, está intimamente ligado ao princípio da dignidade da pessoa humana, fundamento do ordenamento jurídico brasileiro, previsto na Constituição de 1988. Através da análise dos princípios do respeito à autonomia do paciente e da autonomia relacional na Bioética, enxergados sob a perspectiva habermasiana de cooriginariedade entre autonomia pública e privada, pretende-se demonstrar a validade e a importância do testamento vital. Mediante revisão bibliográfica, a análise do tema em diferentes legislações estrangeiras nos permite identificar elementos importantes a serem debatidos, e a análise da matéria no ordenamento jurídico brasileiro permite enxergar algumas das dificuldades que obstam a legitimação do testamento vital no Brasil. Buscam-se respostas que permitam a superação de tais dificuldades, a fim de que o testamento vital possa ser uma ferramenta útil à efetivação da autonomia privada e, consequentemente, da dignidade da pessoa humana.
Abstract: The present article aims to analyze the living will institute in the Brazilian legal system. Due to the patent advances of medicine in the last decades, borderline situations involving life and death have become more common, in which the individual, as a patient, is unable to express his will regarding the medical care and treatment that they want to receive. Although it is not well known in our society, the living will has proved to be a useful and necessary instrument for the fulfillment of private autonomy in those situations. The accomplishment of autonomy is inherently linked to the principle of the dignity of the human person, a foundation of the Brazilian legal system, established in the Constitution of 1988. Through the analysis of the bioethical principles of respect for autonomy and relational autonomy, viewed from the Habermasian perspective of co-originality between public and private autonomy, we intend to demonstrate the validity and importance of the living will. By means of literature review, the analysis of the theme in different foreign legislations allows us to identify important elements to be debated, whereas the analysis of the subject in the Brazilian legal system allows us to perceive some of the difficulties that obstruct the legitimation of the living will in Brazil. Answers that allow us to overcome such difficulties are sought, so that the living will can be a useful tool for the fulfillment of private autonomy and thus of the dignity of the human person.
