Abstract

This paper seeks to address the influence of family entities in the process of social recognition and the consequent introduction of individuals into community life in the context of the current system of social, political and economic organization, namely capitalism. In this regard, the theory of the struggle for recognition postulated by Axel Honneth is used as a theoretical framework from which to address the impacts of capitalism on the possibilities of forming individuals capable of conducting themselves autonomously and the role of the family as an agent of maintenance of this system and shaper of the socialization of individuals who place themselves in the social fabric. Furthermore, a bibliographic review of studies on the process of complexification of family dynamics is used, as well as legislation that regulated/regulates it and/or changed the legal status of its members to analyze its performance as an institution that is simultaneously small compared to the other institutions that make up the legal system and that influences and can be influenced by the social dynamics. This institution is also cross-referenced with statistical data covering gender, race, and class, with a focus on its effects on childhood and youth, in order to consolidate the scope of the contemporary family and its social and legal advances in favor of the complete social recognition of its members. It can be seen, based on these investigative resources, that the family does in fact play a fundamental role in the positive or negative socialization of its members, since it is a primary instance characterized by the vulnerability of its members in relation to each other, especially in the first years of life. However, even though the current stage of Family Law is based on relationships increasingly inclined towards affection, this institution does not shy away from the reproduction and renewal of power dynamics that guarantee the perpetuation of social disparities that, in a cyclical manner, directly impact the conditions of development and satisfactory social integration of its members.
